As the UAE continues to strengthen its position as a global business, investment and talent hub, more business owners, executives and expatriate professionals are travelling frequently between the UAE and overseas markets.
International business commitments, cross-border projects, family visits and, more recently, evolving regional circumstances have also resulted in many residents remaining outside the UAE for longer than originally planned.
Recently, Corridors Advisory (“CA”) has received an increasing number of enquiries regarding re-entry requirements after extended periods outside the UAE.
Many residents assume that a valid UAE Residence Visa automatically allows them to return to the UAE at any time.
However, a valid residence visa does not necessarily mean that all re-entry requirements have been satisfied.
Depending on the visa category and the applicable immigration regulations, certain individuals may be required to obtain a Re-entry Permit or complete other relevant government procedures, where applicable, before returning to the UAE after an extended stay abroad.
Which Visa Categories Require Special Attention?
The following categories of UAE residence visa holders should pay particular attention to the length of time they remain outside the UAE:
- Employment Visa
- Family Residence Visa
- Certain Investor / Partner Visas
- Other Standard Residence Visas
Certain residence visa holders who remain outside the UAE for more than 180 consecutive days may be required to obtain a Re-entry Permit before returning, depending on their visa category and the requirements of the relevant authority.
What About Golden Visa Holders?
Under the current UAE Government policy, Golden Visa holders are generally exempt from the standard 180-day absence rule applicable to ordinary residence visas.
As long as the Golden Visa remains valid, an extended stay outside the UAE will not normally invalidate the residence status solely because of the duration of absence.
Nevertheless, Golden Visa holders should still ensure that their visa remains valid and review their individual circumstances before travelling.
Golden Visa holders should also continue to comply with all other applicable UAE immigration requirements where relevant.
